Kaplan Gets 4 Years Plus

BetOnSports founder Gary Kaplan has been sentenced to 51 months in prison for his involvement with BoS, based on alleged violations of federal racketeering laws.

Kaplan plead guilty in August to charges of conspiracy to violate the RICO laws, conspiracy to violate the Wire Act, and violation of the Wire Act.

He will also forfeit upwards of $50 million in proceeds for alleged criminal and related acts.

Interestingly, one of the crimes defined as racketeering is extortion. Extortion occurs when a person unlawfully obtains either money, property or services from a person, entity, or institution, through coercion.

But isn't that exactly what the US government did to Mr. Kaplan? Coerce him to hand over $50 Million? Oh, of course -- extortion statutes only apply if the coercion is "illegal." And since government is always presumed to be acting legally, or within the laws that they themselves have created, they can never be guilty of extortion by their own definition. That seems all too convenient. If the mafia was able to make the laws, then they would be able to come to your house and bat you in the brain if you didn't hand over $10,000 to them. The only difference between the government and the mafia is that one acts based on alleged legal sanction. In principle, the method of operation is the same.

As reported here previously, former BetOnSports CEO David Carruthers had pled guilty to racketeering charges in April, but later withdrew his plea.
