Prior to the 2009 NFL Football season, Delaware launched a plan for legalized sports betting within the state.
However, professional sports leagues along with the NCAA launched a case seeking an injunction against the state. In the process of hearing the injunction, the US Appeals Court prohibited Delaware from offering single game bets, and decided that Delaware's exemption from Federal laws against sports betting only applied to parlay bets, which Delaware has offered throughout the 2009 football season.
The latest development in this ongoing saga is that Delaware has opted to appeal restrictions on its sports betting lottery to the U.S. Supreme Court.
The Supreme Court only accepts a small fraction of the appeals it receives, but state officials hope it will consider their case.
"We think we have some pretty good arguments," said Tom McGonigle, an attorney for the state.
Delaware's three casinos, which have exclusive license to operate sportsbooks in Delaware, have agreed to pay up to $50,000 in legal fees for filing of the petition.
