DUI Defendant Who Was Caught Drinking on Courthouse Lawn San Jose, Costa Rica. Wednesday 24th Oct. 2007. He allegedly was driving 70 miles an hour down the twisting mountain road with a blood alcohol content of .104, when the legal limit in Nevada is 0.8. “I canīt drive those roads when I am sober” says Ms. Pendleton “I donīt have any idea how he did it stinkin’ drunk."

Ruiz was out on bail following the drunken driving arrest but was released on his own recognizance after he promised a judge he would no longer drink beer and drive. After all this he was back behind bars when he got caught drinking a 12-pack of beer on the Douglas County Courthouse lawn. Officers quickly swooped in and arrested him. When Ruiz was brought back into custody, a different judge refused to release him on his own recognizance and set bail at $100 000. When Mr. Ruiz asked the judge to release him, promising not to drink another beer and drive, Judge Michael Gibbons who set his bail, said he was surprised Mr. Ruiz was released on recognizance the first time. Gibbons said it would be "completely inappropriate" to release him on recognizance again.

"He got it half right by not getting in a car," says Ms. Pendleton "but come on...its Minden ... there is a bar 100 feet away from the courthouse, he couldnīt wait 2 minutes and walk..? While we at LazerWager understand that alcoholism is in fact a disease, we think Mr. Ruiz probably has the partying gene in his system and needs to get it out ASAP" concludes Ms Pendleton.
